Employee Terminations

Termination of the employment relationship occurs when either the employer or the employee voluntarily ends the working relationship based on legally established grounds.

Either party may terminate the relationship at any time for justified cause, particularly when there is a breach of agreed obligations, as set forth under the applicable labor law.

According to the Federal Labor Law, an employer may terminate the employment relationship without incurring liability when the employee engages in any of the following actions:

  • Misleads the employer by presenting false certificates or references that attribute to the employee skills, abilities, or qualifications they do not possess.
  • Commits acts of dishonesty or violence during working hours against the employer, their family members, management or administrative staff, clients, or suppliers, unless there was provocation or self-defense.
  • Commits acts of dishonesty or violence against co-workers during working hours, provided that such conduct disrupts workplace discipline.
  • Commits serious acts of dishonesty or violence outside of work against the employer, their family members, or management/administrative staff, making the continuation of the employment relationship impossible.
  • Causes material damage, whether intentionally or through negligence, to buildings, facilities, or work-related equipment.
  • Endangers the safety of the workplace or individuals within it due to negligence or lack of care.
  •  
  • Engages in immoral acts, harassment, or sexual harassment against any person within the workplace.
  • Discloses trade secrets or confidential information to the detriment of the company.
  • Has more than three unexcused absences within a 30-day period, without justified cause or employer authorization.
  • Disobeys the employer or their representatives without justified cause, provided the instructions relate to the contracted work.
  • Refuses to adopt preventive measures in cases of illness or accidents.
  • Reports to work under the influence of alcohol or narcotics.
  • Is sentenced to imprisonment, preventing the continuation of the employment relationship.
  • In the case of trusted employees (positions of trust), when there is a justified loss of confidence by the employer
